TERMS OF SERVICE

1. Acceptance of terms

By accessing or using the Pepe Mushroom platform ("Platform"), including the website at pepemushroom.io and all associated arcade games, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Eligibility

You must be at least 18 years old to use this Platform. By creating an account, you represent that you are at least 18 years of age. The Platform is not available to residents of jurisdictions where cryptocurrency transactions or online gaming are prohibited by law.

3. Account registration

To access certain features, you may create an account using a username, email, and PIN. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

4. $PMUSH token

Pepe Mushroom ($PMUSH) is a community-driven meme token on the Solana blockchain. $PMUSH has no intrinsic value and should not be considered an investment. The token is used within the Platform ecosystem for rewards and community participation. Arcade games are free to play; no token or purchase is required to play or to enter the monthly competition. The value of $PMUSH may fluctuate significantly, including to zero. We make no guarantees regarding the token's value, liquidity, or future availability.

5. Arcade games and competition

• All arcade games are free to play. There is no entry fee required to play any game on this Platform.
• Monthly skill competition: The Spore Flight flagship game runs a monthly prize competition. Prizes are skill-based and leaderboard-ranked, not purely random.
• Prize eligibility requires either (a) holding $100 USD or more of $PMUSH in a connected wallet, verified by the Platform, or (b) submitting a free no-purchase entry via the Alternative Method of Entry (AMOE) at /competition-amoe. No purchase is necessary to enter or win.
• Prizes are recorded by the Platform and are reviewed and verified for eligibility before any distribution; prizes are not paid automatically. Prize distribution is subject to the Official Rules published at /competition-rules and to applicable law, and the prize program may be modified, suspended, or discontinued at any time as permitted by law.
• Leaderboard rankings, scores, and seasonal standings may be reset at any time at the Platform's discretion.

6. Non-custodial wallet & no deposits or withdrawals

• The Platform is non-custodial. It never takes custody of your $PMUSH or other tokens, never holds or moves your funds, and never requests or stores your private keys or seed phrase.
• There are no deposits or withdrawals to or from the Platform. To qualify for the holder competition tier, you connect a Solana wallet (for example, Phantom) and sign a message so the Platform can read your on-chain $PMUSH balance. This is a read-only verification and moves no funds.
• Any in-game balance shown in your account is internal arcade points for leaderboard and gameplay purposes only. Points are not cash, are not redeemable for cash, and carry no monetary value.
• You are responsible for the security of your own wallet. The Platform is not responsible for losses arising from your wallet, third-party wallet software, or the Solana network.

7. Prohibited conduct

You agree not to:

• Use bots, scripts, or automated tools to interact with the Platform or games
• Exploit bugs, glitches, or vulnerabilities for unfair advantage
• Create multiple accounts to circumvent rules or manipulate leaderboards
• Engage in fraudulent activity, money laundering, or any illegal conduct
• Attempt to reverse-engineer, hack, or interfere with Platform operations
• Use offensive, threatening, or inappropriate usernames or communications

8. Anti-cheat and fair play

The Platform employs anti-cheat measures to ensure fair competition. Scores may be validated, and suspicious activity may result in score removal, account suspension, or permanent ban without prior notice. Decisions regarding fair play violations are final.

9. Intellectual property

All content on the Platform, including but not limited to game designs, artwork, code, text, logos, and the Pepe Mushroom brand identity, is the property of Pepe Mushroom or its licensors and is protected by applicable intellectual property laws.

10. Disclaimer of warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THE PLATFORM IS AT YOUR OWN RISK.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPE MUSHROOM AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, LOSS OF DATA, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF THE PLATFORM.

12. Assumption of risk

You acknowledge that cryptocurrency transactions carry inherent risks, including but not limited to price volatility, regulatory changes, smart contract vulnerabilities, and network failures. You assume full responsibility for any losses incurred through your use of $PMUSH and the Platform.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your account and access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately.
